VIRTUAL GOODS OR ITEMS POLICY


Viewchat app. program (the “Program”) is provided by Viewchat (“Platform”) for users to enjoy contents, send texts, and do video or voice chatting. The Program is open to users of the services who are aged 18 or older and is subject to the following terms and conditions of this Virtual Goods or Items Policy. Those under 18 years cannot take part in the Program.

BCINNOVATION is solely in control of any Virtual Goods or Items. The Virtual Goods or Items are intellectual property licensed to you, not owned by you. We may change the value or characteristics of the Virtual Goods or Items at any time, including entirely removing the Virtual Goods or Items from Platform.

If you are a resident of an EU Member State, we may only do so to the extent (i) such changes are made without additional cost to you, (ii) you are informed in a clear and comprehensible manner of the change, and (iii) such change is made for one of the following reasons: maintaining the overall balance of Platform, accounting for new modes or mechanics of Platform, ensuring a fair environment for all users, complying with applicable laws, or otherwise keeping the Virtual Goods or Items Terms consistent with best practices and commercial norms.

To the extent that the change negatively impacts your access to or the use of the Virtual Goods or Items, you are entitled to terminate the related agreement free of charge. In cases of negative impact on the Virtual Goods or Items, BCINNOVATION will inform you reasonably in advance of the features and time of the change.

Users who can take part in the Program are as follows:

Users under the age of 18 (or the age of majority in your jurisdiction), may participate in the Program with the permission of a parent or legal guardian.
Only users 18 years old or older (or age of adulthood in your country) can buy Points and Gifts or buy Points to send Gifts to other users.
These BCINNOVATION Virtual Goods or Items Terms apply to any transaction of Virtual Goods or Items in an BCINNOVATION Platform, as set forth below. These BCINNOVATION Virtual Goods or Items Terms may be modified at any time by us in our sole discretion.

POINTS

Who can purchase Points?

Users of the services who are aged 18 (or age of adulthood in your country) or older may purchase virtual “points” (“Points”) using authorized payment methods and through payment providers made available and authorized by us.

About buying Points

The price of the Points will be made public when you purchase them. All charges and payments for Points will be made in the currency specified at the time of their purchase through the relevant payment mechanism. Currency exchange settlements, foreign transaction fees, and payment channel fees are based on your agreement with the applicable payment provider.
You will be responsible for the payment of your purchase of Points. Once you have completed the purchase of the Points, your user account will receive the Points.
If you wish to make change of your purchase, please contact us at the email address below. Please note that this change can have an adverse effect on the prices as well as other factors of your purchase. If you live in the European Union (EU), you have certain rights to pull out of your purchase under the Consumer Rights Directive and its implementing legislation. However, you acknowledge and agree that your forfeit your right to cancel or withdraw your purchase at this point that the Company start providing you with the Points as soon as your purchase is complete.

About using Points

Points can be used to purchase Virtual Gifts. Points cannot be exchanged for cash, or legal tender, or currency of any state, region, or any other political entity, or any other form of credit.
Points can only be used in our Platform and as a part of the Services and cannot be combined or used in conjunction with other promotions, coupons, discounts, or special offers, except those designated by us.
No Points may be assigned or transferred to any other user of the Services or third party except as expressly permitted by us in writing. The sale, barter, assignment, or other disposal of any Points, other than by us, is strictly prohibited.
Accrued Points do not constitute property and are not transferable: (a) upon death; (b) as part of a domestic relations matter; or (c) otherwise by enforcement of laws.
Any Points assigned, sold, or otherwise transferred without the express written consent of us are void. The Company will terminate the account of any user who violates this restriction, forfeit Points from his or her account, and he or she will be subject to liability for damages and litigation and transaction costs.
All Points of a user will expire automatically upon termination of the user’s account for any reason.
You agree that we have the absolute right to manage, regulate, control, modify and/or eliminate such Points, where we have a valid reason to do so, in any general or specific case, and that we will have no liability to you based on its exercise of such right. If we decided to eliminate Poins from our Service completely, we will do so after providing reasonable notice to you.

GIFTS

Who can buy Gifts?

The user of our Service who is aged 18 (or age of adulthood in your country) or older may purchase virtual gifts (“Gifts”) by exchanging Points for Gifts.

About purchasing Gifts

Gifts constitute a limited license to certain features of digital products and services. The exchange rate between each Point and Gift will be informed to you on our Platform at the time of the exchange. Open prices include taxes unless it is otherwise under positive laws in your country. If any Gifts are subject to sales tax in your country and you have not paid the sales tax to us, then you will be responsible for the payment of such sales tax and any related penalties or interest to the relevant tax authority.
You agree that we have the absolute right to manage, regulate, control, modify and/or eliminate such exchange rate as we see fit in our sole discretion, in any general or specific case, and that we will have no liability to you based on our exercise of such right. Please note that this change can have an adverse effect on the prices as well as other factors of your purchase.
Except as otherwise set out in this policy, all sales of Gifts are final, and we do not offer refunds for any purchased Gifts. When you have exchanged your Points for Gifts, such Points will be deducted from your user account and credited with Gifts.
Gifts cannot be converted into or exchanged for Points or cash, or be refunded or reimbursed by us for any reason.
Gifts exchanged or received by a user do not constitute property and are not transferable: (a) upon death; (b) as part of a domestic relations matter; or (c) otherwise by enforcement of laws.
We may replace previously exchanged copies of Gifts, if we determine in our sole discretion that the Gifts exchanged or received by a user are corrupted or otherwise damaged. We reserve the right to terminate or take other appropriate action against the account of any user that is abusing the Program or this Virtual Items Policy.

About using Gifts

You may use Gifts to rate or show your appreciation for another chatting user or users who has uploaded an item of User Content (“Content Provider”) or.
When this functionality is available on the Service, you can contribute Gifts to User Content by clicking the “Give Gift” button below the relevant User Content.
When you have contributed a Gift to an item of User Content, this Gift will be removed from your account, and converted into Breads (as defined and further explained below) in the Content Provider’s account.
Please note that when you give a Gift to another user, the recipient of the Gift can see the details of the Gift that you gave.

BREADS

Who can have Breads?

The user of our Service who is aged 18 (or age of adulthood in your country) or older may purchase virtual gifts (“Gifts”) by exchanging Points for Gifts.
In a live stream product, a Content Provider who is aged 18 (or age of adulthood in your country) or older will be entitled to have virtual credits (“Breads” or “Coins” in some regions).

About using Breads

Breads are a yardstick of the popularity of the relevant User Content. Breads depend on the Gifts a Content Provider receives. In its absolute and sole discretion, the exchange rate of Gift and Breads is decided by the Company from time to time.

Users cannot purchase Breads.

No Breads may be assigned or transferred to any other user of the Service or third party except as expressly permitted by us in writing. Breads cannot be exchanged for Points or Gifts.
The sale, barter, assignment, exchange, transfer, or other disposal of any Breads other than by us, is expressly prohibited.
Accrued Breads do not constitute property and are not transferable: (a) upon death; (b) as part of a domestic relations matter; or (c) otherwise by enforcement of laws.

You agree that the Company has the absolute right to manage, regulate, control, modify and/or eliminate Breads in its sole discretion, in any general or specific case, so the Company will have no liability to you of its exercise of such right.

Withdrawing Breads

At any time, a Content Provider can see how many Breads he or she has accrued in real-time by checking their user account.
A Content Provider can choose, by selecting the relevant options in their user account, to withdraw Breads in exchange for monetary compensation (denominated in US dollars). The applicable monetary compensation will be calculated by us based on various factors including the number of Breads a user has accrued.
The withdrawal of Breads will be subject to the following Terms and any additional information provided in the withdrawal instructions that are provided to you at the time of such withdrawal, including the applicable daily limits on withdrawal amounts. The rate of withdrawal will be displayed at the point of withdrawal.
You agree that the Company has the absolute right to manage, regulate, control, modify and/or eliminate withdrawal functions in its sole discretion, in any general or specific case, so the Company will have no liability to you of its exercise of such right. The applicable cash payment will be made directly into your nominated PayPal account or other third-party payment channel account (if applicable).
Your name needs to be an exact match to your PayPal account information and your PayPal account needs to be verified. It is your responsibility to ensure that you provide your PayPal account information (or other payment channel) correctly. You are responsible for any losses caused by incorrect PayPal account information (or other payment channel) provided by you. Payment will not be sent to the email address of your account, a PayPal account first inconsistent with your name, and an account that has not been verified by PayPal.
The Company may, at our sole discretion, request you to provide information to verify your identity (including your first and last name and your ID number).
We have the right to verify your identity, age (by requesting a photocopy of your ID card, or other proof as we may require) and eligibility qualifications to our satisfaction prior to any payment. Although we aim to fulfil all withdrawal requests in a timely manner, we do not guarantee fulfilment within a specific period (including any estimated timings set out at the time of withdrawal). We will not be liable to you or any third party for any failure to fulfil a withdrawal request within such time.
If you wish to convert into a currency other than USD, this option may be available within your PayPal account (or other payment channel if applicable). However, this is at the discretion of PayPal (or other payment channel if applicable) and the terms and conditions of PayPal (or other payment channel if applicable), including any applicable fees, will apply to such currency conversion.
If you are subject to any taxes imposed by any jurisdiction on these payments, you will be responsible for the payment of such taxes (including any related penalties or interest) to the relevant tax authority. We reserve the right to deduct any applicable taxes prior to making such payment if we determine that we are required to do so by positive laws. We also have the right to request you to submit certifications of taxes and to report to tax authorities the amount of your payment and/or withholdings from your payment.
We have the right to deduct Breads from your account if you violate these Terms.
We may cancel the operation of the Breads incentives at any time. If we cancel the Breads incentives, you shall have no right or entitlement to any financial compensation in respect of any Bread accrued prior to the date of cancellation of the incentives that have not been converted into cash using the mechanism set out in these Terms.
You agree that when a user is entitled to a refund for the Gifts he or she purchased, the amount of your withdrawal in relation to such Gifts shall be forfeited. You are responsible for refunding such withdrawal within 5 business days from the point of receiving our notice to you.

All the Points, Gifts, or Breads in your account will be forfeited immediately upon the cancellation or termination of your account. There will be no refunds for any unused or unredeemed Points, Gifts, or Breads, so we recommend you use them before terminating your account.
