TERMS AND CONDITIONS SPECIFIC TO UGC (USER-GENERATED CONTENT)
1. ViewChat might include means for members to share content created by them, referred to as UGC. Within the maximum extent permitted by applicable laws, ViewChat automatically retains the rights to use, reproduce, modify, adapt, publish, translate, reuse, create derivative works from, and distribute any UGC created by members. This includes but is not limited to images, videos, customer service requests, idea submissions, suggestions, and message postings. These rights are irrevocable, non-exclusive, not confined to any specific geographical location, and come without any associated fees. Members agree to these rights, which allow ViewChat to use their UGC for any purpose, including commercial, without compensation. Members also agree to waive any moral rights or similar rights in their UGC.2. ViewChat has the ability to monitor, approve, verify, or pre-block any UGC posted by members. ViewChat reserves the right to remove, block, edit, move, or deactivate any UGC at its discretion. Especially if a member posts inappropriate UGC on ViewChat, it can be deleted as soon as possible (within 24 hours at the latest). Members can also report inappropriate UGC of other members to the ViewChat monitoring team. If a member's UGC contains external links, the member must ensure that the linked content is appropriate for the community. This rule applies to both embedded links that play content automatically and simple links indicating website locations. Posting links can be considered aiding copyright infringement (Supreme Court decision on 9th September 2021, 2017도19025). Thus, if a link or referenced website is deemed inappropriate, ViewChat can immediately remove it. ViewChat only monitors, edits, or removes UGC to the maximum extent permitted by law. Members agree not to hold ViewChat responsible for any damages arising from their UGC or that of other members.
3. Members agree that their UGC will not infringe upon third-party intellectual property rights, both now or in the future, and that they won't need to pay any fees or consider third-party rights when using UGC in the manner specified in this agreement. Members can't upload or post UGC that infringes upon third-party copyrights, trademarks, or other intellectual property rights. They also can't upload UGC that violates someone's privacy or image rights. Members are solely responsible for all their UGC, which includes transmitting, posting, or providing any text, files, links, software, photos, videos, sounds, music, or other materials. Members should only upload UGC they've created and should refrain from uploading others' UGC.
4. Members agree to grant all ViewChat members access to and use of their UGC, without additional notice, attachment, or compensation. This right includes the ability to access, use, transmit, and distribute the UGC, as long as it doesn't violate ViewChat's policies.
5. ViewChat collects content, communications, and other information when members use ViewChat, including account creation, content creation, or sharing, and communicating with others. This can include metadata related to the content provided by members, such as the location of a photo or the date a file was created. Content displayed through features provided by ViewChat, like cameras, is also included.
6. Members can share information about themselves on ViewChat. In such cases, any member of ViewChat can access that information and associate it with the member who posted it. ViewChat does not guarantee the accuracy, efficacy, or truthfulness of UGC created by members. Such features include uploading or submitting UGC, comparing statistics/personal records/rankings with other users, searching for other users by username, and more. However, if a member's UGC, such as statistics/personal records/rankings comparison, violates ViewChat's UGC policy, ViewChat can delete it at any time.
