User-Generated Content (UGC)

1. ViewChat may include means by which content created by certain members (“UGC”: User Generated Contents) can be shared with other members. To the fullest extent permitted by applicable law, ViewChat automatically retains the rights and license to use, reproduce, modify, adapt, publish, translate, sublicense, create derivative works from, and distribute any UGC created by members (including, without limitation, images, videos, customer service requests, ideas, suggestions, and message posts). These rights held by ViewChat are irrevocable, non-exclusive, worldwide, and royalty-free.
Members agree that ViewChat may use such rights for any purpose, including commercial purposes, without separate compensation. Members also agree to waive any moral rights or similar rights in the UGC they create and not to assert such rights.

2. ViewChat may monitor, approve, review, or pre-block UGC posted by members. ViewChat reserves the right, at its discretion, to remove, block, edit, move, or disable members’ UGC. In particular, if a member posts inappropriate UGC on ViewChat, ViewChat may delete such UGC as quickly as possible (within a maximum of 24 hours). Members may also file complaints with ViewChat’s monitoring team regarding inappropriate UGC posted by other members. If a member’s UGC contains links to content outside the website, the member must ensure that the content at such links and the content outside the website are suitable for the community. This rule applies not only to “embedded” links that automatically play video or other media when clicked, but also to simple links indicating the location or path of a website. Merely posting a link may constitute aiding copyright infringement (Supreme Court en banc decision, 2021. 9. 9., Case No. 2017Do19025). Therefore, if a link you post or a referenced website is inappropriate, ViewChat may delete it immediately.
To the fullest extent permitted by applicable law, ViewChat only monitors, edits, or removes members’ UGC. Members agree not to hold ViewChat liable for damages arising in connection with their own or other members’ UGC (including, without limitation, defamation, harassment, or losses/damages related to false warranties).

3. Members agree that the UGC they provide (i) does not presently or in the future infringe any third party’s intellectual property rights or other rights (collectively including, without limitation, “moral rights”), and (ii) that the use of the UGC in the manner set forth in this Agreement does not presently or in the future require the payment of royalties or other consideration to any third party.
Members may not upload or post to ViewChat any UGC that infringes any third party’s copyright, trademark, or other intellectual property rights, may not upload UGC that infringes any third party’s privacy rights or portrait rights, and may not require the payment of royalties or other consideration to any third party with respect to their UGC. Members are responsible for all of their UGC. This includes transmitting, posting, or otherwise making available any text/file/link/software/photo/video/sound/music, or other information or materials. Only UGC that you created yourself may be uploaded to ViewChat. Do not upload other people’s UGC to ViewChat.

4. To the extent that members allow other members to access and use their UGC, members also agree to grant all ViewChat members the right to access and use their UGC and to transmit and distribute it, to the extent permitted under ViewChat’s policies, without further notice, attribution, or compensation to the member.

5. ViewChat collects content, communications, and other information that members provide when using ViewChat (including creating an account, creating or sharing content, or sending messages or otherwise communicating with others). This may include information contained in or related to the content provided by members (such as metadata), including the place where a photo was taken or the date a file was created. It may also include what is displayed through features provided by ViewChat, such as the camera.

6. Members may share information about themselves on ViewChat. In that case, any ViewChat member may access that information and associate it with the member who posted it. ViewChat does not guarantee the accuracy, effectiveness, or truthfulness of UGC created by members. Such features may include uploading or submitting UGC, comparing your and other users’ statistics/personal best records/leaderboards, and searching for other users by username. However, if UGC such as statistics/personal best records/leaderboard comparisons created by a member violates ViewChat’s UGC policy, ViewChat may delete such UGC at any time.

7. ViewChat is a space where fans and creators can communicate safely. Content falling under any of the following categories is strictly prohibited and will be subject to immediate deletion and account sanctions.
- The following content is strictly prohibited
- Pornographic and sexually explicit content
- Illegal recordings and content filmed or distributed without consent
- Sexual content involving children or minors (CSAM)
- AI-generated false sexual content, including deepfakes
- Violent or hate-promoting content
- Content that infringes another person’s personal information or portrait rights
- Content containing fraud, spam, or false information
If prohibited content is posted, measures such as immediate deletion of the content, suspension or permanent termination of the account, and reporting to investigative authorities pursuant to applicable laws may be taken, and the relevant member shall bear all resulting legal liability.

8. In accordance with the Act on Special Cases Concerning the Punishment of Sexual Crimes and the regulations of the Korea Communications Commission, ViewChat is required to operate filters to detect and block illegal recordings.
- Illegal recording filters are applied to all user-generated content (images and videos).
- An AI-based automatic harmful-content detection system is operated.
- Content detected as illegal recordings is immediately blocked and deleted.
- Records of detection and processing are maintained and preserved in accordance with applicable laws.
- A dedicated monitoring team monitors content 24 hours a day.

9. ViewChat places the highest priority on the protection of minors.
- Sexual content targeting or involving minors under the age of 18 is prohibited in any form.
- Access by minors is restricted through an age verification system during sign-up.
- If illegal content involving minors is found, it is reported immediately to investigative authorities.

10. By signing up for the ViewChat service, members agree to this UGC Policy and reconfirm the prohibited content policy when uploading content.
- Members bear legal responsibility for all UGC they post. Any civil or criminal liability arising from the posting of prohibited content rests entirely with the relevant member, and ViewChat bears no responsibility whatsoever.
